WEBSITE TERMS OF USE

These Terms and Conditions govern your access to and use of truematehome.com and any pages, forms, features, or content operated by True Mate LLC, doing business as True Mate Home Improvement. They apply to the website and online inquiries. They do not replace a signed proposal, home-improvement contract, change order, warranty, financing agreement, or other project-specific document.

Important: These are website terms. Any remodeling or installation work is governed by the written proposal, contract, selections, change orders, notices, and warranty documents accepted for that project.

1. Acceptance of These Terms

By accessing or using this website, you agree to these Terms and Conditions and acknowledge our Privacy Policy. If you do not agree, do not use the website. If you submit a request on behalf of another person or organization, you represent that you are authorized to do so.

2. Website Purpose

This website provides general information about True Mate Home Improvement, our service area, bathroom-remodeling services, shower and tub options, project-planning information, and ways to request a consultation or estimate. Website content is for general informational and marketing purposes and is not construction, engineering, architectural, plumbing, electrical, financial, insurance, or legal advice.

Submitting a form, calling, texting, emailing, requesting an estimate, or scheduling an appointment does not create a contractor-customer relationship, obligate either party to proceed, reserve an installation date, or form a contract for work. A project begins only under the written documents accepted by the parties.

3. Eligibility and Acceptable Use

You may use the website only for lawful purposes and in accordance with these Terms and Conditions.

Do not submit false, misleading, fraudulent, or unauthorized information.

Do not attempt to gain unauthorized access to the website, its hosting environment, forms, accounts, or connected systems.

Do not introduce malware, automated scraping tools, excessive requests, or other technology that disrupts or burdens the website.

Do not copy, republish, modify, sell, or commercially exploit website content without written permission.

Do not use the website to violate another person’s rights or any applicable law.

4. Service Area and Project Availability

True Mate Home Improvement primarily serves Wilmington, North Carolina, and surrounding coastal communities. Information on the website does not guarantee that a property, project, product, or requested schedule is within our service area or current capabilities. We may decline an inquiry or project for any lawful business reason, including location, scope, site conditions, scheduling, product availability, permitting, licensing, insurance, safety, or project economics.

5. Estimates Pricing and Promotions

Website prices, starting prices, ranges, examples, promotions, and savings claims are general marketing information unless a written project proposal expressly states otherwise. They are not binding offers and may change or be withdrawn without notice.

When advertised, the statement that tub-to-shower conversions start at $8,995 installed is based on a standard alcove configuration with base product selections. Final pricing depends on field measurements, existing conditions, demolition findings, plumbing or electrical requirements, permits, access, selected wall system, shower base, door, hardware, storage, seating, accessories, labor, taxes, and other project-specific factors.

Only a written proposal or contract issued for the property and accepted by the parties establishes the final scope, price, allowances, payment schedule, exclusions, and project terms. Promotions may have eligibility requirements, deadlines, geographic limits, and other written conditions. Unless expressly stated, offers may not be combined.

6. Project Agreements Control

If you hire True Mate Home Improvement, the signed proposal, contract, specifications, product selections, drawings, change orders, warranty documents, and required notices will control the project. If these website Terms and Conditions conflict with an accepted project document, the project document controls for that project.

Website descriptions do not expand a written scope of work, create a warranty, or promise a particular completion date. Changes to project scope, price, products, or schedule must be handled through the project’s written process.

7. Products Images and Design Inspiration

Product names, colors, patterns, dimensions, finishes, features, and availability are subject to manufacturer information, field conditions, and supply. Screen settings, lighting, photography, printing, production variation, and surrounding finishes can affect appearance. Review physical samples and project documents before making final selections.

Some website images may be renderings, generated images, manufacturer-authorized materials, stock images, or design inspiration rather than completed True Mate projects. Captions or labels should be read together with the image. A displayed layout or accessory does not guarantee that the same configuration is available or appropriate for your home.

8. Safety and Accessibility Information

References to lower thresholds, shower seating, handheld showerheads, support bars, slip-resistant surfaces, comfort, accessibility, aging in place, or easier entry describe planning considerations and available features. No feature can prevent every slip, fall, injury, or accessibility problem.

Unless a signed project document expressly says otherwise, website content is not a certification that a design complies with the Americans with Disabilities Act, a medical recommendation, or a guarantee that a configuration is suitable for a particular person. Discuss individual mobility or medical needs with an appropriate professional.

9. Appointments Scheduling and Access

Requested appointment dates and installation timelines are not guaranteed until confirmed. Schedules may change because of weather, inspections, permits, product availability, concealed conditions, trade coordination, emergencies, or other circumstances. Project-specific scheduling terms will be stated in the applicable written documents.

For in-home visits, an adult with authority to discuss the property and proposed work should be present unless other arrangements are confirmed. You are responsible for providing safe, lawful access to the property and identifying known hazards, occupants, pets, association rules, or access restrictions that may affect the visit.

10. Calls Emails and Text Messages

When you provide contact information and request information, an estimate, a consultation, or service, you authorize us to contact you as reasonably necessary to respond and communicate about the inquiry, appointment, or project.

Marketing or automated text messages will be sent only when the appropriate consent has been provided. Consent to receive marketing messages is not a condition of purchasing goods or services. Message frequency may vary, and message and data rates may apply. You may opt out of marketing texts by replying STOP. You may request help by replying HELP or contacting us directly.

Opting out of marketing communications does not prevent us from sending non-marketing messages reasonably necessary for an active inquiry, appointment, transaction, project, warranty request, safety issue, or legal obligation.

11. Information Photos and Other Submissions

You represent that information, measurements, photos, videos, plans, drawings, and other materials you submit are accurate to the best of your knowledge and that you have the right to provide them. You grant True Mate a limited permission to use those materials to evaluate, quote, plan, perform, document, service, insure, or administer the requested project and related business operations.

Submitting project materials does not by itself authorize public advertising use. True Mate will seek any additional permission required before publicly using identifiable customer project photos, videos, testimonials, names, addresses, or other personal project information for marketing.

12. Reviews Testimonials and Results

Reviews and testimonials reflect the experience and opinion of the person providing them. Individual results, costs, schedules, and experiences vary by project. We do not promise that every customer will have identical results. True Mate does not authorize fake reviews, undisclosed paid endorsements, or materially misleading edits to customer feedback.

13. Intellectual Property

The website and its text, graphics, logos, photographs, videos, layouts, downloadable materials, and other original content are owned by or licensed to True Mate or the identified rights holder and are protected by intellectual-property laws. True Mate, the True Mate logo, and associated branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or authorization without written permission.

You may view and print reasonable portions of the website for personal, noncommercial project planning. No other license is granted. Manufacturer names and third-party marks belong to their respective owners.

14. Third Party Websites and Services

The website may link to or integrate services operated by third parties, including social-media platforms, map providers, manufacturers, payment providers, financing providers, scheduling tools, review platforms, or website services. Third parties control their own content, availability, security, privacy practices, and terms. A link does not necessarily mean that True Mate endorses every statement, product, or service on the linked site.

15. Website Availability and Disclaimer

We try to keep website information useful and current, but we do not guarantee that every page is complete, accurate, uninterrupted, secure, or free of errors. The website may be changed, suspended, or unavailable without notice.

To the fullest extent permitted by law, the website and its content are provided on an as-is and as-available basis without warranties of any kind regarding website operation or informational content. This website disclaimer does not replace or limit an express written project warranty and does not waive rights that cannot lawfully be waived.

16. Limitation of Liability for Website Use

To the fullest extent permitted by law, True Mate and its owners, employees, agents, and website service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from access to, inability to use, or reliance on this website or linked third-party content.

This section applies to website use only. It does not determine responsibility for contracted work, personal injury, property damage, warranties, payment obligations, or other matters governed by a signed project agreement, insurance, or applicable law. Nothing in these Terms and Conditions excludes liability or consumer rights that cannot legally be excluded.

17. Indemnity for Misuse of the Website

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable costs caused by your unlawful misuse of the website, your intentional violation of these Terms and Conditions, or materials you knowingly submit without authorization. This provision does not apply to ordinary consumer inquiries or limit rights that cannot be waived.

18. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It also describes cookies, analytics, advertising technologies, communications, data retention, security, and privacy choices. The Privacy Policy is incorporated into these Terms and Conditions by reference.

19. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Subject to any different requirement in a signed project agreement or applicable law, legal proceedings concerning website use must be brought in a court with jurisdiction in New Hanover County, North Carolina.

Nothing in this section prevents either party from using a lawful small-claims process or another forum that applicable law requires.

20. Changes to These Terms

We may update these Terms and Conditions to reflect changes in the website, services, business, or law. The revised terms will be posted with a new effective date. Changes apply prospectively to website use after posting and do not retroactively alter an accepted project agreement.

21. Severability and No Waiver

If a provision of these Terms and Conditions is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
